1. Acceptance of Terms

By accessing or using the PRAHO Platform services provided by PragmaticHost SRL ("Company", "we", "us", "our"), you ("Customer", "you", "your") agree to be bound by these Terms of Service ("Terms").

If you do not agree to these Terms, you may not access or use our services. These Terms constitute a legally binding agreement between you and PragmaticHost SRL.

2. Description of Services

PragmaticHost SRL provides web hosting and related services through the PRAHO Platform, including but not limited to:

• Shared and VPS web hosting
• Domain name registration and management
• Email hosting services
• SSL certificate provisioning
• Technical support services
• Automated backup solutions

Service specifications, features, and limitations are described in the specific service plans available on our platform.

3. Account Registration and Security

3.1 Registration Requirements

To use our services, you must create an account by providing accurate, current, and complete information. You agree to update your information promptly if it changes.

3.2 Account Security

• You are responsible for maintaining the confidentiality of your account credentials.
• You must immediately notify us of any unauthorized access to your account.
• We strongly recommend enabling two-factor authentication (2FA).
• You are responsible for all activities that occur under your account.

3.3 Business Customers

Business customers must provide accurate company information, including VAT registration number (CUI/CIF) for Romanian companies. This information is required for invoicing and tax compliance.

4. Payment Terms

4.1 Pricing and Fees

All prices are displayed in Romanian Lei (RON) and include VAT (19%) for Romanian customers. Prices may change with 30 days' prior notice.

4.2 Payment Methods

• Bank transfer (Romanian and international)
• Credit/debit cards (Visa, Mastercard)
• PayPal (where available)

4.3 Billing Cycle

Services are billed in advance according to the billing cycle selected (monthly, annually, etc.). Proforma invoices are issued before service activation; fiscal invoices are issued upon payment.

4.4 Late Payment

Invoices are due within 14 days of issue. Late payments may result in service suspension. We reserve the right to charge interest on overdue amounts at the legal rate.

4.5 Refund Policy

We offer a 30-day money-back guarantee for new hosting services. Domain registration fees, SSL certificates, and add-on services are non-refundable. Refund requests must be submitted through the support ticket system.

5. Acceptable Use Policy

You agree to use our services only for lawful purposes and in compliance with these Terms. You must NOT use our services to:

Violation of this policy may result in immediate service termination without refund. We reserve the right to remove content that violates these terms.

6. Intellectual Property

6.1 Our Property

The PRAHO Platform, including its software, design, logos, and documentation, is owned by PragmaticHost SRL and protected by intellectual property laws.

6.2 Your Content

You retain all rights to the content you upload to our services. By using our services, you grant us a limited license to store and transmit your content as necessary to provide the services.

7. Data Protection and Privacy

We process personal data in accordance with the General Data Protection Regulation (GDPR) and Romanian Law 190/2018. Please review our Privacy Policy for detailed information about how we collect, use, and protect your data.

7.1 Customer Data Responsibility

If you collect personal data through services hosted on our platform, you are the data controller for that data and are responsible for compliance with applicable data protection laws.

8. Warranties and Disclaimers

8.1 Service Level

We strive to maintain 99.9% uptime for our hosting services. Service credits may be issued for downtime exceeding this threshold, as specified in our Service Level Agreement.

8.2 Disclaimer

9. Limitation of Liability

To the maximum extent permitted by Romanian law:

• We shall not be liable for indirect, incidental, special, or consequential damages.
• Our total liability shall not exceed the fees paid by you in the 12 months preceding the claim.
• We are not liable for data loss; you are responsible for maintaining backups.

10. Termination

10.1 By Customer

You may cancel your services at any time through the customer portal or by contacting support. Prepaid fees are non-refundable except as specified in our refund policy.

10.2 By Company

We may suspend or terminate services immediately if you:

• Violate these Terms or Acceptable Use Policy
• Fail to pay invoices within 30 days
• Engage in illegal activities

10.3 Data After Termination

Upon termination, we will retain your data for 30 days to allow for retrieval. After this period, data may be permanently deleted unless legally required to be retained.

11. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of Romania.

Any disputes arising from these Terms shall be submitted to the exclusive jurisdiction of the courts of Bucharest, Romania.

For consumers in the EU, this does not affect your statutory rights or your right to bring claims before the courts of your country of residence.

Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes at least 30 days before they take effect. Your continued use of our services after changes become effective constitutes acceptance of the modified Terms.
